1. Agreement to Terms
By accessing or using the NeverMiss website and services ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. SMS/MMS Messaging Terms
By checking the SMS opt-in box on our contact form, you expressly consent to receive recurring automated promotional and informational SMS/MMS text messages from NeverMiss (including but not limited to appointment reminders, follow-up messages, marketing offers, and service updates) at the mobile phone number you provided. Consent is not a condition of any purchase.
2.1 Message Frequency
Message frequency varies based on your engagement and communication preferences. You may receive up to 8 messages per month. Alerts, reminders, and promotional messages may be sent at different intervals.
2.2 Opting Out (STOP)
You may opt out of receiving SMS messages at any time by texting STOP to any message you receive from NeverMiss. You will receive a single confirmation message confirming that you have been unsubscribed. After opting out, you will no longer receive text messages from NeverMiss unless you re-subscribe. No further messages will be sent following an opt-out request.
2.3 Help

2.4 Message & Data Rates
Message and data rates may apply depending on your mobile carrier and plan. NeverMiss is not responsible for any charges from your wireless carrier. Please contact your carrier for details on your messaging plan.
2.5 Supported Carriers
Our SMS program is supported on all major US wireless carriers including but not limited to AT&T, Verizon, T-Mobile, Sprint, US Cellular, MetroPCS, Cricket, Boost Mobile, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.
2.6 No Sharing or Selling of Phone Numbers
We will never sell, rent, or share your phone number or opt-in information with any third party for promotional or marketing purposes. Your information is used solely to deliver the messaging services you consented to.
2.7 Consent Scope
By opting in, you acknowledge that you are the owner or authorized user of the mobile device associated with the phone number provided. Your consent applies only to the NeverMiss messaging program described on this page and does not extend to any other program or organization.
3. Privacy & Data Use
Phone numbers and personal information collected through our forms are used solely for the purpose of providing our services and communicating with you as described. For full details, see our Privacy Policy.
4. Service Description
NeverMiss provides done-for-you phone, SMS, and email communication automation systems for med spa practices. Service details, pricing, and availability are subject to change without notice.
5. HIPAA Compliance
NeverMiss systems are designed to be HIPAA-friendly. We do not transmit protected health information (PHI) via SMS unless a Business Associate Agreement (BAA) is in place with the subscribing practice. It is the responsibility of each practice to ensure compliance with all applicable healthcare regulations.
6. Limitation of Liability
NeverMiss shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to lost revenue or missed appointments.
7. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the revised terms.
